Gas Industry Co had intended to consider Contact's second ground of appeal, if Vector had reasonably withheld consent, in a 'merits review'. However, due to divided submissions on whether Gas Industry Co could or should consider Contact's second ground of appeal Gas Industry Co's Final Recommendation invited the VTC participants to resolve the issues regarding the VTC drafting as it affects ground two. In the event that the parties reach a view that the VTC provides for appeal ground 2 then the matter should be referred back to Gas Industry Co.
